Michigan Legislative Update
Several people attended the Michigan Republic conference on Mackinac
Island and met many Senators and Representatives. In addition, several
people have participated in several campaign fund raisers of candidates.
We need you to take an active role to meet the candidates, help them
understand the issues, and provide the campaign support
Here is a summary
of some recent legislation in progress and the strategy is to call your
Senator AND Representative to get them to sign up for a bill or take
action.
- Pass HB 5267
(equal parenting) – Hearings begin December 19
- Pass HB 4161
(eliminate presumption of Mom custody in unwed situations). Has been
introduced to the Senate Families committee.
- Pass SB 436 and
HB 5088 (paternity). Is moving forward.
- Military Custody
Bills HB 5100 and SB 0714 – Passed the House and Senate unanimously
and awaiting signature.
- Introduce legislation
to eliminate the Strict Liability law MCL 750.165 on child support.
- Veto/modify the
US Bradley Amendment USC 666 at the federal level - child support.
- Update VAWA (Domestic
Violence) to include language for gender neutrality. Delayed in the
US Senate.
- Repeal SB
263 (Hearsay evidence allowed for domestic violence)
- Introduce legislation
to require update of child support guidelines based on SER or foster
care guidelines.
- Enforce FOC to
follow child support guidelines when you loose your job, disabled,
activated in the military (Michigan FOC frequently will not
modify support)
Check this site
for the bills: http://www.legislature.mi.gov/
Additionally
1. Tell 2 people every day.
2. Attend and meet legislators campaigning for office
What I want to EMPHASIZE is that DADS and Moms of Michigan
is not a Fathers Rights organization. Our message is one of gender
neutrality and that the Best Parent is Both Parents.
We will need your financial support to get these bills passed.

The
Fathers’ War - www.amconmag.com/2005/2005_10_24/article2.html
By Stephen Baskerville
While our country focuses on the war abroad, many of our soldiers fight
personal battles here at home—or more accurately, can’t
fight. They are losing their families and getting little help from an
administration that claims to “support the troops” while
doing nothing to protect the parental rights of the fathers it sent
into combat. (more…)

[5] BOWEN, SECRETARY
OF HEALTH AND HUMAN SERVICES v.GILLIARD ET AL.
[6] APPEAL FROM
THE UNITED STATES DISTRICT COURT FOR THE
WESTERN DISTRICT OF NORTH CAROLINA.
[66] The family is an institution "deeply rooted in this Nation's
history and tradition." Moore v. East Cleveland, 431 U.S. 494,
503 (1977). Our society's special solicitude for the family reflects
awareness that "it is through the family that we inculcate and
pass down many of our most cherished values, moral and cultural."
Id., at 503-504 (footnote omitted).*fn2 As a result, we have long
recognized that "freedom of personal
[ 483 U.S. Page
612]
choice in matters
of family life is a fundamental liberty interest protected by the
Fourteenth Amendment." Santosky v. Kramer, 455 U.S. 745, 753
(1982). See also Cleveland Board of Education v. LaFleur, 414 U.S.
632, 639 (1974). Therefore, "when the government intrudes on
choices concerning family living arrangements, this Court must examine
carefully the importance of the governmental interests advanced and
the extent to which they are served by the challenged regulation."
Moore, supra, at 499.*fn3
[67] A fundamental
element of family life is the relationship between parent and child.
As we said in Lehr v. Robertson, 463 U.S. 248, 256 (1983): "The
intangible fibers that connect parent and child have infinite variety.
They are woven throughout the fabric of our society, providing it
with strength, beauty, and flexibility. It is self-evident that they
are sufficiently vital to merit onstitutional protection in appropriate
cases." We have thus been vigilant in nsuring that government
does not burden the ability of parent and child to sustain their vital
connection. See, e. g., Santosky, supra, at 753; Stanley v. Illinois,405
U.S. 645 (1972); Meyer v. Nebraska, 262 U.S. 390 (1923). *fn4
[68] "The
rights of the parents are a counterpart of the responsibilities they
have assumed." Lehr, supra, at 257. When parents make a commitment
to meet those responsibilities, the child has a right to rely on the
unique contribution
"your individual child custody situation will
not
easily change until it changes for us all"
