The Massachusetts
Joint Physical Custody Ballot Question won overwhelmingly yesterday.
Congratulations to Massachusetts Fathers & Families, the Fatherhood
Coalition, the Children's Rights Council of Massachusetts, the Berkshire
Fatherhood Coalition, and others. According to Ned Holstein of Fathers
and Families of Massachusetts, the coordinator of the effort, "approximately
85% voted for joint physical custody of children...The lopsided margin
of victory was greater than that of any elected official in Massachusetts,
including John Kerry, Barney Frank, or Jim McGovern. In two towns, it
passed by about 2-1...and in every other town the margin was even larger,
often approaching 8-1 or 9-1. Approximately 600,000 Massachusetts citizens
voted on our non-binding ballot question, representing every area of
the state, every ethnic group and every social class."

On His Side last
Sunday we discussed one of the most bizarre and tragic murders of our
time--The
Lohstroh Case: Alienating Mother Pushes 10 Year-Old Boy to Kill Father.
Several of Dr. Rick Lohstroh's friends have contacted us in defense
of their murdered friend. According to Sumit Guha, M.D., one of Rick's
friends from medical school, Rick may have foreseen his death.
During the show
we played a taped phone conversation of Lohstroh's ex-wife threatening
to make false child abuse allegations and saying "wait 'till you
see the next round [of charges]." According to Dr. Guha, after
the first false allegation, Rick "couldn't see his kids. He lived
in a filthy bleak little apartment with little or no money to support
himself for months. No one even would talk to him about why they were
keeping his children from him. I'm not sure if you can imagine the persecution
you feel being a law biding physician and father all your life and suddenly
have people who don't even know you treat you in this manner...As you
said on the air, Rick would rather have been raped. Meanwhile, his wife's
boyfriend was residing in his new home being called 'dad.'"

Against Paternity Fraud Laws
The stories of
victims of paternity fraud often provoke disbelief. Many men are falsely
assigned paternity in default judgments and are compelled by the state
to pay 18 years of child support for children whom DNA tests have proven
are not theirs. Many of these men are not properly served notice of
the paternity proceedings, never get their day in court and have no
idea they are "fathers" until their wages are garnished.
Often by the time
these men realize what has been done to them, the statute of limitations
for challenging paternity has already passed, and sometimes lose half
or more of their take-home pay to child support, arrearages, interest,
and penalties -- often to support children they have never even met.
In other cases,
men are misled into supporting children who are not theirs. Sometimes
unwed men are urged to declare paternity of their girlfriend's or ex-lover's
children at or near birth, and such declarations, when later found to
be the product of deception, are hard to undo. Other men are deceived
by wives who bear children through adulterous liaisons and who mislead
them into thinking that the children are theirs.
In response to
the paternity fraud crisis, several states, including California, Georgia,
Maryland, Alabama and others, have passed paternity fraud legislation.
Now paternity fraud activists' success has created
a backlash.
Law
Professor Melanie Jacobs has emerged as a leading voice in the backlash
against paternity fraud laws. Family law attorney Jeffery
Leving has authored legislation to make paternity fraud a criminal
offense. Jacobs and Leving will debate paternity fraud laws and
their philosophical underpinnings on His Side with Glenn Sacks on Sunday,
November 7 at 5 PM PST/8 PM EST.
